Product Warranty:

SharperDrills™ Ltd. (“SDL”) warrants to the Purchaser of a Product from SDL, with valid proof of purchase that the Product and all accessories provided by SDL are free from material defects in material and workmanship, pursuant to the following terms and conditions, when installed and/or used normally and in accordance with operating instructions. This limited warranty extends only to the Purchaser of the Product purchased and used in the United States of America.

During the limited warranty period, SDL, at its sole option, will repair, replace or return the purchase price, without charge, a Materially Defective Product. If SDL repairs the Product, SDL may use new or refurbished replacement parts. If SDL chooses to replace the Product, SDL may replace it with a new or refurbished Product of the same or similar design. SDL will retain defective parts, modules, or equipment. Repair, replacement and/or refund the purchase price, at SDL’s option, is the Purchaser’s exclusive remedy. The limited warranty period for a Product is ONE (1) Year from the date of purchase of the Product. If SDL repairs or replaces a Materially Defective Product under the terms of this limited warranty, the limited warranty also applies to the repaired or replaced Product for the time remaining on the original one-year limited warranty.

This limited warranty does not cover a Product that has been subjected to misuse, accident, shipping or other physical damage, improper installation, abnormal operation or handling, or neglect; a Product that has been damaged due to repair, alteration, or modification by anyone other than by SDL or an authorized service representative of SDL; a Product whose warranty/quality markings, serial number plates, and the like have been removed, altered or rendered illegible; a Product purchased, used, serviced, or shipped for repair outside the United States.

Except as provided by applicable law, the Purchaser assumes the risk of loss or damage during transit and transportation and the responsibility for delivery or handling charges incurred in the transport of the Product to the Purchaser’s location. SDL will return a repaired or replaced Product under this limited warranty to Purchaser, transportation, delivery, or handling charges prepaid. Purchaser must return any Materially Defective Product with the entire original package and contents to SDL along with a description of the malfunction, and valid proof of purchase (invoice, sales receipt, or original Product order); and provide the Purchaser’s name and complete and correct mailing address and phone number.

This limited warranty is the complete and exclusive agreement between the Purchaser and SDL. It supersedes all other written or oral communication related to the Product. SDL provides no other warranties for the Product.

SDL MAKES NO OTHER RESPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AND DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY. IN NO EVENT WILL SDL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR REVENUE, INABILITY TO USE THE PRODUCT,  OR ASSOCIATED EQUIPMENT, THE COST OF SUBSTITUTE EQUIPMENT, AND CLAIMS BY THIRD PARTIES, RESULTING FROM THE USE OF THE PRODUCT.
